SUSTAINABLE INHERITANCE TRANSFER IN THE DIGITAL AGE: DIGITAL PROBATE IN TURKISH LAW

Synopsis

Inheritance is an important concept that is regulated in every country today and serves to transfer assets between generations. Assets include real estate and movables. All assets, rights and debts of the deceased person pass  to his heirs. The assets of the heir are called inharitance. Inheritance is a 
different concept from assets and inheritance. The features of being measured in money and being counted in the law are at the forefront. Today, digital assets are also included among the assets of the inheritor. Within the scope of digital assets, there are elements such as cryptocurrencies, internet 
domains, social media accounts. In the study, while defining the digital probate, its elements and features will be emphasised. As a method in the study, digital probate will be analysed within the framework of the court decision in terms of Turkish Law. In the conclusion part of the study, the 
necessity of making a regulation on digital probate is emphasised.
